RESPONSIBILITIES:

­­­­­­­­­­­­­­­­­­­­­­­­­CONTEXT OF POSITION: The Disabilities Law Program (DLP) provides free legal representation to children and adults with physical and mental disabilities to protect them from abuse and neglect and to advocate for their legal rights (e.g., civil rights, educational services, medical services, housing, government benefits, treatment in the least restrictive environment). The DLP serves as Delaware’s Protection and Advocacy System for people with disabilities (“P&A”). For more information about what a P&A is, see: https://youtu.be/m3vYxSe3s4M.

In this position, the Advocate will have primary responsibility for implementing the DLP’s Protection and Advocacy for Voting Access (PAVA) program. Additionally, as time and PAVA activities permit, under the supervision of program attorneys the Advocate will assist clients with disabilities throughout Sussex County, Delaware on a variety of disability-related legal matters. The applicant for this position must be able to interact effectively with and be sensitive to the special needs of individuals with physical and mental disabilities and their families.

As the PAVA Advocate, primary duties will include coordinating statewide PAVA activities including polling place surveys, conducting community outreach and developing training and other materials for the community, social media, voter registration events, and other activities. PAVA duties are expected to take up 50% or more of the Advocate’s time.  In addition, the Advocate will also conduct client intake and screening, investigation of facts, legal research, drafting of reports and letters, and other work as directed for the DLP.

In addition to providing legal support for attorneys, if the Advocate’s schedule allows, the Advocate may under the supervision of an attorney represent clients in meetings and administrative proceedings. The Advocate is required to see clients in institutions, nursing homes, group homes, correctional facilities, client homes, and at other community sites. This Advocate will also work with community and provider groups, and will provide community education and training to groups about issues affecting people with disabilities.

DUTIES: 

Duties of the PAVA/DLP Advocate position include:

  1. Provide advocacy services to people with disabilities on issues related to voting and voting access;
  2. Engage in voting-related policy advocacy and systems change efforts;
  3. Develop training and education materials, and conduct training, community education and outreach activities, on issues relating to voting and voting access;
  4. Keep informed on advocacy strategies, technology advances, and other best practices designed to increase participation by people with disabilities in the voting process;
  5. Participate in statewide and local community groups and councils, including those that meet at night and/or on weekends, as necessary.
  6. Provide paralegal support to program attorneys, including: interviewing clients, determining eligibility for services, and conducting factual investigations and preliminary merit assessments.
  7. Become and remain well-informed regarding basic legal principles applicable to area(s) of practice, attending training conferences as needed or requested by supervising attorney(s).
  8. Under supervision of attorneys, represent clients in meetings and administrative hearings when appropriate and where the advocate’s schedule permits.
  9. Perform legal research; draft correspondence and other documents under the supervision of an attorney.

CONTEXT OF POSITION: The Floating Clerical Staff Member at Community Legal Aid Society, Inc. (CLASI) is a versatile role responsible for handling secretarial, receptionist, translation, and errand duties in both our Kent and Sussex County offices. This individual will provide essential support by typing and performing clerical functions for attorneys, paralegals, and administrative staff as assigned by the Office Managers. Additionally, they will serve as the primary back-up to the receptionists, covering lunch breaks, vacations, and other absences.

When not assigned to cover one of the main receptionists in their designated office, the Floating Clerical Staff Member will divide their time between the Kent and Sussex County offices, ensuring consistent support across both locations. This role also involves running errands, handling outgoing mail, and performing other general clerical duties as assigned.

The clerical staff member will be supervised by the Office Managers of both the Kent County and Sussex County offices.

RESPONSIBILITIES (See also Attachment A below):

  • Serve as back-up to receptionists in both Kent and Sussex County offices;

The Family Representation Unit Supervising Attorney in Kent or Sussex County will help launch a Family Representation Unit at Community Legal Aid Society, Inc. (CLASI). The Family Representation Unit will aim to ensure a fair and equitable child welfare system, by leading, administering, and supporting the effective delivery of multidisciplinary representation and services to indigent parents facing Division of Family Services intervention in the parent-child relationship, including dependency, neglect, abuse, and termination of parental rights actions. Through zealous, creative, and persistent advocacy the Unit will protect, advocate, and advance the rights of parents facing the removal of their children by the Division of Family Services. The Supervising Attorney will handle a caseload and supervise other parent representation attorneys, and collaborate with/supervise social workers, peer mentors, and engage in systemic advocacy. The Supervising Attorney will report to a Managing Attorney for the Family Representation Unit and/or Executive Director of CLASI.

DUTIES:
1. In conjunction with Managing Attorney, coordinate and supervise legal work of Family Representation Unit staff.
2. In conjunction with Managing Attorney, oversee and provide support and supervision to staff in on-going casework and impact work, with a focus on representation of parents in dependency, neglect, abuse, and termination of parental rights matters in Kent and Sussex Counties.

CONTEXT OF POSITION:

Community Legal Aid Society Inc. (CLASI) (Delaware) is a statewide, non-LSC funded nonprofit law firm whose mission is to combat injustice through creative and persistent advocacy on behalf of vulnerable and underserved Delawareans. CLASI has offices throughout Delaware. CLASI is also Delaware’s designated Protection and Advocacy agency for individuals with disabilities.

The successful candidate will develop a practice that focuses on the following:

1) The traditional priorities of the Elder Law Program that focus on preserving income, resources, and self-determination for vulnerable seniors;

2) The VOCA (Victims of Crime Act) grant, which focuses on the civil legal needs of victims of crime who are elderly; and

3) Advocacy on behalf of manufactured homeowners residing in manufactured home communities with regard to disputes with community owners.

The attorney will be based in any of CLASI’s three offices (Wilmington, Dover, or Georgetown) but will have responsibilities and cases statewide. The attorney will also spend some of their time working on manufactured housing issues. The attorney will supervise paralegals and work with the rest of the ELP team.

 

Minimum Knowledge and Qualifications

The attorney must:

  • have a commitment to social and economic justice, as well as a desire to work directly with low-income individuals, especially elder clients;

Essential Duties and Responsibilities

  • Provide direct services to clients in Elder Law Program in accordance with ELP priorities and grant requirements relating to victims of crime. Salary and Benefits

Effective March 1, 2022, the Delaware Supreme Court has authorized Qualified Tenant Advocates to represent tenants in eviction matters, both in and out of court, under the supervision of a legal aid attorney.

Qualified Tenant Advocates, under the supervision of attorneys in the Housing Unit, will assist clients with eviction defense in each of the three Delaware Counties: New Castle, Kent or Sussex County. The Qualified Tenant Advocate (“QTA”) will focus on helping clients facing eviction to achieve housing stability. The QTA will handle intake and client representation duties. The QTA will focus on identifying any potential defenses a tenant may have that would save the tenant from being evicted and will represent the tenant in alternative dispute resolution, resource navigation, negotiations, and/or in any eviction hearing in the Justice of the Peace Court.

The Qualified Tenant Advocate will have paid, employer-provided, on-the-job training. In addition, this position will provide opportunities for professional development.

Community Legal Aid Society, Inc. (“CLASI”) is recruiting testers to help investigate complaints of discrimination in the housing market here in Delaware. To do this, CLASI conducts testing for compliance with Fair Housing laws statewide. Testing is a controlled process wherein a tester will either call or visit a housing provider posing as an interested party. Testers will have to collect information that will be utilized to assist in investigations. CLASI uses these tests to determine if housing providers are discriminating against potential buyers/renters based on their race, color, familial status, disability, national origin, religion, sex, gender identity, or sexual orientation.

Testers must attend a 2 to 3-hour training session. Following this training, the test coordinator will contact the Tester when a test is ready to be performed and ask if they are able to commit to conducting that test. If the Tester agrees, then the test coordinator will send all the information that they need to complete the test. CLASI relies on email for communication to notify testers, set up scenarios, and submit tests.

Testers are paid a stipend ($50 – $90) for each test that is conducted, and they are reimbursed for mileage, tolls, and postage. Testers are also paid $40 for completing their training.

Testers must:

– Be capable of following instructions, and of being impartial and observant;

– Have excellent writing skills and attention to detail;

– Be capable of submitting testing materials timely;

– Have reliable transportation;

– Have a telephone.

Testers must NOT:

– Be a licensed competitor of the person or organization to be tested in the listing, rental, sale, or financing of real estate;

Attorney Positions
Community Legal Aid Society, Inc. (“CLASI”) welcomes applications from attorneys interested in volunteering in one of our three offices for work in our Poverty Law, Elder Law, and Disabilities Law Programs.

Law Clerk Positions
CLASI welcomes applications from law students interested in volunteering in one of our three offices during the summer or school year. Law clerks may receive credit or work study funding from their law schools or may be eligible for a grant from a public interest organization.

Paralegal Positions
CLASI welcomes applications from individuals interested in volunteering in any of our three offices to help with tasks such as client interviews, document preparation, discovery and community education.

Clerical Positions
CLASI welcomes applications from individuals interested in volunteering in any of our three offices to help with tasks such as typing, filing, answering telephones, document scanning and preparation, and special event planning.

Salary and Benefits

Salary:

Effective October 1, 2024, the entry-level salary is $­­­­­75,000 for attorneys and $45,000 for paraprofessionals. On April 1 of each subsequent year, the entry-level salary is adjusted by the CPI-U for the Philadelphia-Wilmington-Atlantic City area for the immediately preceding 12-month period ending December 31, provided that such CPI-U is within the range of 2% to 7%. Credit for years of experience is factored into a percentage of the entry level salary as follows:

Base pay for administrative and clerical positions is included in the job posting. Salary increases are calculated in a manner similar to that described above. Benefits described below apply to all positions.
